Note: Please note that even you can apply as
Promoter of proposed partnership firm (The allotment order will be issued only after submission of registered partnership deed).
Promoter of proposed Pvt. Ltd. Co./Public Ltd. Co. (The company should be formed within three years from the date of Agreement to lease/lease).
Promotor of Proposed Co-Operative Society.
After approval of application by land allotment committee, for allotment of plot/shed/gala, the offer letter will be issued on the same day or maximum on next day.
Along with the offer letter Blue Application Form affixing Rs. 20/- Adhesive Stamp will be sent to the applicant.
In approved layout for non-polluting industry the allotment will be done within 15 days.
Along with Possession Receipt the letter at Annexure C will be given to the allottee. This letter is   nothing but N.O.C from MIDC to apply for Power, Telephone Connection, MPC B Consent, Water   Connection, Plan Approval, Consent to Mortgage in favour of the Financial Institute and also for various approvals required will be given to the allottee. This letter is nothing but N.O.C from MIDC to apply for Power, Telephone Connection, MPC B Consent, Water Connection, Plan Approval, Consent to Mortgage in favour of the Financial Institute (List at Annexure D) and also for various approvals Required.

Execution of Final Lease /Predetermined Lease & Renewal of Lease
Documents Required for Execution of Final Lease/Predetermined Lease
The final lease for a period of 95 years in respect of allotted plot will be executed on production of copy of BCC,
Pay up-to-date annual lease rent.
For predetermined lease, detailed loan sanctioned letter issued by the Financial Institution duly indicating the plot no. of MIDC & name of the allottee/s.
Note: R.O./AM will confirm from Ex.Engr./Dy.Engr. Whether the allottee has paid the latest water bill and same should not be called from the allottee.
Documents Required for Renewal of Lease.
Pay upto date annual lease rent.
Xerox copy of proof of Registration of Lease together with the copy of the Lease
Xerox copy of Deed of Assignment together with its registration receipt, if the transfer is permitted earlier.
Note: RO/AM should confirm from Executive Engineer/Dy. Engineer whether the unit has paid the latest water bill and the copy of the receipt should not be called from the applicant.
Documents Required for Extension of Time Limit. (Effective steps taken)
Due to the various reasons, if allottee is not in a position to complete the construction work and obtain BCC or started the production, after expiry of prescribed time limit as follows. By considering the progress of the work and effective steps taken by the allottee, MIDC may take the decision for granting further extension on recovery of non refundable additional premium i.e. 5 % of the premium rate prevailing on the date of expiry of time limit.

Classification of group of the Industrial Areas is mentioned in Rate List, which is at Annexure F
NOC & SSI registration issued by the Technical Advisor, MIDC, Mumbai - 400 093 in MMR area. In other than MMR area SSI Registration from concerned DIC. IEM/ LOI from Govt. of India for large-scale units.
Consent issued by the Maharashtra Pollution Control Board or Copy of acknowledgement of application submitted for MPCB Consent.
Note: Copy of Plan Approval, Sanction of water connection, whether applied for BCC will be confirmed by R.O./A.M. from E.E./D.E.

Documents Required for Extension of Time Limit. (Effective steps taken)
If allottee after taking over possession of the said plot and on approval of the plan, commence the construction on plot and complete the same but not obtained the BCC, and started the production, the extension of the time limit will be granted on submission of the following document/s In such cases, additional premium is to be recovered upto the date of commencement of production.
Copy of permanent S.S.I. registration showing the date of commencement of production (SSI Regn issued prior to 31-12-1993).
A letter from the Financial Institution to whom the Plot has been mortgaged (for Term Loan) stating that the unit has been gone into production from a particular date.
A Certificate from Department of Industrial Safety & Health (DISH) showing the date of commencement of production. ( for the unit registered with DISH under Factory Act)
Certified copy of Central Excise gate pass; if applicable.
First three bills of M.S.E.B. in connection with Production and Certified copy of Sales Tax Certificate; if applicable and List of machinery installed with purchase value & date of purchase certified by C.A. and Copies of first three sale bills & purchase bills. (in case of job works, copies of material received challans & job work charges bills).

Documents Required for Refund of Premium.
In case, if allottee wants to surrender the plot/ shed / Gala, it can be accepted for refund of the premium after submitting the following documents.
Request letter signed by all the original allottees / all the partners (if it is a partnership firm).
Original copy of Agreement to Lease.
Original copy of Possession receipt.
Latest No Dues Certificate from the concerned E.E., /D.E. MIDC.
No Dues Certificate from the Financial Institution, if the plot/ shed / Gala is mortgaged.
Copy of the Board Resolution about surrender of the plot, if it is a private limited company/Ltd. Co.
A copy of the Registered " Cancellation Deed ".
Note: If Sr. No. b & c is not forthcoming then the Indemnity Bond on Rs. 50/- Stamp Paper be submitted.

Documents Required for Waiproc OF Marginal Distance / Amalgamation
If allottee wants to amalgamate two or more adjacent plots, he can request for waiproc of marginal distances or amalgamation of the plot after submitting the following documents:-
Architect's Certificate regarding details of construction if construction is started.
Pay upto date annual lease rent.
Note: R.O./A.M. will confirm about the latest water bill paid, details of the construction, B.C.C., Measurement Plan showing the utilisation of Plot/s from E.E./D.E.

Documents Required for Subletting Of The Premises
Sub-letting of the premises is permitted by the Corporation on payment of sub-letting charges, which are calculated on the basis of 10% of prevailing premium rate per annum on occupied area for respective use. Sub-letting charges will be payable by allottee in advance for one year. Sub-letting is done only for one year and renewable every year. If sub-letting charges/fees/compensation is not paid by the allottee or allottee refused to pay the sub-letting charges will be recovered from the Occupi.

Request from the original allottee for subletting of premises.
Request from the sub-lettee/s and with their constitution of the firm.
Copy of Building Completion Certificate, (BCC) if applicable.
Total built-up area on the plot.
Individual sub-letted area/area proposed to be sub-letted.
Date of occupation of each of sub-lettee/s.
Plan showing the area occupied/proposed to be sub-letted by each of the sub-lettee/s.
If any open space is subletted or to be sub-letted or if any area occupied/proposed to be Occupied.
Activity which he/she/it/they undertakes like:-
Industrial
Commercial
Residential
Power requirement.
Water requirement
Any pollution is expected from the process.
Note: R.O./A.M. will confirm from E.E./D.E. regarding Latest Water bill Paid.

Documents Required For Transfer of Plot/Shed/Gala
It is very common, allottee requests for transfer of plot; Corporation had prepared its own transfer guidelines. The transfer guidelines are divided into two parts.
Formal Transfer which are as follows: -
The natural person/individual wants to change the constitution and wants to include his blood relations as partner viz. husband / wife / sons / daughters / father/ mother/ brothers/ sisters of the original allottee/s or in case original partners wants to delete any of the persons (this does not include the legal persons) such transfer shall be formal transfer and shall be permitted on recovery of the minimum process fee as Annexure G 
Transfer because of death i.e. by bequeath / will / heirship shall be permitted without recovery of process fee / transfer charges.
All involuntary transfer including amalgamation, demerger etc. under the directions of competent court/tribunals/appropriate government not being this nature of permission shall be permitted on recovery of minimum process fee.
Transfer from promoter of the proposed private limited company to private limited company incorporated by promoter, will be permitted without recovery of transfer charges provided the company is incorporated within three years from the date of execution of agreement to lease or date of possession whichever is earlier, provided that the application for transfer is made within a period of 3 years along with relevant documents and the original promoter holds minimum 20% shares in total paid up capital of the limited Co. so incorporated and undertaks to hold 20% shares in the total paid up capital of the company incorporated for a period of 2 years from the date of grant of permission for transfer by the Corporation, such transfers will be treated as formal transfer.
A transfer from promoter of Co-operative Society to the Co-operative society registered under Maharashtra Co-operative Societies Act shall be treated as formal transfer.
Mere change in the name of the proprietory concern / partnership firm without change in the individual proprietor / partners or mere change in the name of the limited company under the provisions of the company's act 1956 or where there is a change of management of the limited company not involving transfer of interest in land/shed/gala there being no transfer of interest such changes will be noted by the Corporation on recovery of transfer charges mentioned in the relevent circular.
Non-formal Transfer: -
Non-formal transfer will be permitted subject to the recovery of 10% of differential premium where the allottee has consumed at least 10% of the permissible FSI.
If the permissible F.S.I. consumption is less than 10%, then transfer will be permitted on recovery of 30% of differential premium.
For transfer of shed allotted by MIDC, if the allottee has started the production within 3 years then 10% of differential premium will be charged and if the allottee has not started the production within 3 years then 30% of the differential premium will be charged.
Note:
R.O./A.M. will confirm whether the applicant is having B.C.C., & latest water bill paid from E.E./D.E. if applicable in transfer cases.
The document/s already in the file will not be called from the allottee.

If there is change in partnership, copies of the change in partnership certified by the Chartered Accountant as true copies with the proof of registration of the same with the Registrar of Firms. The link of change should be estabproclished in the changes if there are more than one change in the partnership, copies of documents of Partnership /Retirement/Dissolution / Fresh Partnership deeds (with proof of Registration).
Name and Relationship of the incoming partners with the original partners who are licensees / lessees.

Documents Required for transfer Through Financial Instistution
Financial Institution's request letter for transfer of plot in the name of its nominee alongwith the following documents / information.
Prescribed application form duly filled in by the transferee together with a copy of project report (if there is change in product of items.) and Required process fee by D.D. drawn in favour of CEO, MIDC.
Constitutional documents i.e. a copy of partnership deed together with its registration receipt if it is a partnership firm. A copy of Memorandum and Articles of Association together with its Incorporation Certificate and Company's resolution if it is a company registered under Companies Act, 1956.
Copy of Sale Deed or Agreement for Sale together with its registration receipt.
A copy of possession receipt issued by the Financial Institution.
Total outstanding against the defaulter.
The amount at which the sale has been finalized and the amount of cash down payment received by Financial Institution.
Whether the surplus amount is received / receivable by the Financial Institution and if so; how much?

Detail loan sanctioned letter issued by the Financial Institution duly indicating the plot no. of MIDC, name of the allottee/s.
NOC/s from the financial institution/s, if the mortgage permission is granted previously.

Documents Required for COLLATERAL SECURITY.
Request letter from allottee/s (together with a copy of the Board Resolution in case of private Limited / Limited company).

Detail loan sanctioned letter issued by the financial institution duly indicating the Plot No. of MIDC, name of the allottee/s and mortgage permission Required as a collateral security in favour of a sister concern company (by indicating the name of the firm with its constitution).
NOC/s from the financial institution/s, if the mortgage permission is granted previously.

A letter from the Financial institution / Banks accepting the following condition:- In case of default in repayment of Loans by Sister Concern the Bank exercise its rights under the mortgage, the Bank shall first dispose of the assets of Sister Concern and in case the realisation of the Bank from such sale does not satisfy its dues, then only the leasehold interest of MIDC allottee/s shall be disposed off and in that case the Bank shall first pay to the Corporation the transfer charges / fees as per the guidelines for non formal transfer prevelent at that tiime and the Bank shall satisfy its dues from balance realisation on such sale of the said plot and any other assets of allottee/s.
An undertaking on Rs. 20/- stamp paper from the Lessee stating that in case financial institution fails to pay the transfer charges / fees, the Lessee will pay the same Annexure K 

Documents Required for ULC Clearance (If applicable)
A letter addressed to the concerned officer mentioned in Annexure H   & affixed Court fee stamp of Rs. 20/- on the letter. The letter should consist the following information.
Name of Industrial area.

Area of Plot in sq.m.
Date of Agreement to Lease.
Date of Possession (attach Xerox copy of the Possession Receipt/copy of transfer order)

MPCB Consent for Air & Water or acknowledgement of submission of application to MPCB.
Provisional NOC from C.F.O. & F.A., MIDC, for high rise building (Defination of high rise building is mentioned in D.C.Rules of MIDC) and hazardous industry having fire hazards/fire risk, the list of such industries is enclosed at Annexure C Annexure I . The application be submitted to S.P.A., MIDC who will submit it to C.F.O. & F.A., MIDC.
Appointment letter of Architect, Structural Engineer, from allottee and Acceptance letter from Architect & Structural Engineer, along with valid licence.
Supervision memo from Architect & Structural Engineer.
Detail drawings of proposed factory building (4 sets for building and 3 sets for drainage connection)

Guidelines for Plan Approval in MIDC Area
All drawings should be in metric system.
Four sets of drawing for building plan and three sets of drawing of drianage plans be submitted.
All drawings shall be as per MIDC's D.C. Rules.
Drawing are to be ink signed by Architect & allottee with ruber stamp on each drawing.
Submite the detail section of the fencing/compound wall (Scale 1:25 cm).
Detailed section through culvert at cross drain ( Scale 1:25 cm.) providing minimum 900 mm opening for coastal areas and minimum 600 mm opening in other areas.
Drawings shall include all floor plans with two elevations, two sections of building (one section passing through stair case & Toilet block) - 1:100, Septic tank with cross section (1:50),
Gate should be opened inside the plot & if the plot is facing in two or more sides of the road, then the gate shall be located at list 15.00 Mt. away from the junction of the road.
Your should provide water storage tank having minimum capacity of your one-day's requirement (minimum provision of 24 hours water).
Provisions of Effluent Treatment plant should be made if applicable.
You have to pay Development charges & scrutiny fees as Annexure J
Structures allowed in marginal space with Free F.S.I.
Watchman cabin/Time office of 8.00 m2 carpet area with one linear dimension not exceeding 3.00 R.M.

While issuing the BCC, SPA will check whether the unit has made the provisions as per Prov. NOC issued by CFO & FA MIDC.
Guidelines for getting BCC in MIDC Area.
Amended plans in metric systems if the changes are made during construction period (Plans in four sets).
Consent to operate from MPCB or an undertaking on Rs. 20/- stamp paper that he will take it within 6 months from the date of undertaking for Chemical and Hazardous industries and for other type of Industries atleast acknowledgement of submission of application to MPCB.
Time limit extension if Required.
Certificate of licensed Architect, stating that the work is carried out satisfactorily under his supervision.
Certificate from the qualified structural Engineer, regarding soundness of the structure, quality of materials used on the work & stating structure is constructed as per approved design.
Get the drainage plans approved, if not done previously through Architect along with "L" section of drainage line with all details.
Certificate from the Architect stating that the internal, external drainage works are carried out as per rules & approved drawings.
True copy of approval from Explosive Department, if there is any storage of explosives.
Temporary structure, if any within the plot area to be demolished before approaching for Building Completion Certificate.
Compound wall & approach road should be constructed as per approved plans and cross drainage work having NP2 class pipe of Required size, but not less than 900 mm. dia. in coastal area and 600 mm in other than coastal area should be provided on the approach road.
Certificate of the owner starting that provision for 24 hrs. storage of water is made.
After submission of the revised plans, the concerned representative of MIDC will accord the approval after site verification.
True copies of approval issued by the Foods & Drugs Department, (if applicable)

Water Connection (Temporary for construction of factory buildings)
Documents Required
Agreement form in triplicate duly filled & attested with Rs. 20/- adhesive stamp (copy of agreement will be available with concern division office at Rs. 65/- each)
Necessary prior permission for the crossing of road shall be obtained.
Time limit extension if Required.
Note: Copy of allotment order, possession receipt of plot, shed, gala will be called from R .O. / A.M. by Dy. Eng./ Ex.Eng.
Guidelines
Two nos. 15 mm dia. tested water meter of approved make shall be purchased by allottee. One tested water meter shall be fixed near the tapping point on your service line as per the requirement, under the instructions of E.E./D.E. of MIDC.
The water rate for temp. Water supply connection shall be 1.50 times the regular water supply rate.
After construction of factory building as per approved plans & obtaining Building Completion Certificate from concern authority, the water rate shall be charged at regular water supply rate from the day of submission of B.C.C.
Necessary prior permission for the crossing of road shall be obtained (if applicable).
Payments
Security deposit equiprocent to amount of 90 days water supply consumption.
Water connection charges (depends on size of water supply connection.)

Documents Required for Permanent Water Connection
You have already submitted the documents for Temp. Water Connection and following additional documents will be Required for Permanent Water Connection.
Consent to operate from MPCB or an undertaking on Rs. 20/- stamp paper that the allottee will take it within six months from the date of undertaking alongwith acknowledgement of submission of application to MPCB for chemical and hazardous industry and for other type of industry atleast acknowledgement of submission of application to MPCB.

Documents Required for " Provisional No Objection Certificate" From Fire Deptt.
Provisional NOC from CFO & FA MIDC will be Required only for high rise buildings (definition of high rise buildings is mentioned in D.C.Rules of MIDC) and for hazardous industry having fire hazard / fire risk. The list of such industries is enclosed at Annexure I 
One set of all drawings in metric system which should include Block Plan, Typical Floor Plan, Elevation Plan etc,

Brief Note on the Fire Prevention and Protection measures proposed by the company.
Block Plan of company should give the details of main entrance, other entrance to plot, surrounding of plot like any other company, road etc,, Marginal spaces, approach roads around the plant, capacity of underground water storage tank and other details like transformer yard, utility block, raw material & finish goods storage, tank farm area, storage of hazardous gases, liquids etc, for e.g. LPG, A - class petroleum products, LDO etc.
Elevation Plan and Typical Floor Plan showing exits, Fire escapes, travel distance along the travel line, terrace level water storage, location of fire duct, fire extinguishers, hydrant system, sprinkler system, alarm system etc. Details of Basement, Sub Basement, their ventilation system and exits.
List of raw material and finish goods with their quantity, their storage place in the plant should be marked on block plan. Details of Centralized Air Conditioning System. Provision of Fire Dampers.
Copies of approvals taken from Govt. agencies like Chief Controller of Explosives (CCE), Excise Deptt. Gas Authority, MPCB, DISH, etc.
If the company is in production copy of BCC or part BCC and DCC issued by MIDC should be enclosed.
Copy of Registration and License of the company.
For New applicant after getting Provisional NOC only plan approval should be issued.
The Architect shall certify the plans , that they abide with D.C. Rules of MIDC & provisions of NBC wherever necessary.
